 All types of Development Application preparation and coordination

Plansight works closely with the client, architects, engineers, solicitors and other property and design professionals to prepare and coordinate the submission of competent development applications.

Legislative and local requirements for development application submission are detailed and usually extensive. Proper preparation of a development application can avoid costly time delays and lead to quicker processing times.

We ensure a full and complete submission and strive to ensure that all aspects of the DA submission are comprehensive, properly detailed and would withstand scrutiny at both Council and if necessary in the Land and Environment Court

 Preparation of Statements of Environmental Effects

Vital in the development application submission is the Statement of Environmental Effects (SEE).

The SEE introduces the site and its context. It provides a detailed description of the development proposal, presents the relevant planning regime which may include State Environmental Planning Policies, Regional Environmental Plans, Local Environmental Plans, Development Control Plans and Development Control Codes.

The SEE carries out an assessment of the performance of the proposal in relation to the planning controls all of which must be statutorily considered under S.79C of the Environmental Planning and Assessment Act 1979 along with the environmental impact of the development and the suitability of the site for the development.

The SEE may include justification of any variation to the proposed planning controls if proposed and if the control is a statutory one, such as appearing in a Local Environmental Plan, an Objection pursuant to State Environmental Planning Policy No.1 will be included.

 Local Environmental Plan, State Environmental Planning Policy & Development Control Plan advice and interpretation

Plansight can provide clients with opinions in relation to such provisions and will advise whether further legal opinion is necessary.

 Opinion and advice as to the planning compliance and merit of proposals

Plansight can prepare objections to development on behalf of neighbours and other interested parties if we feel that there are reasonable grounds for such a submission.

 Property rezoning submissions and Draft Local Environmental Plans

On occasion it becomes apparent that that the current zoning of land may be inappropriate or redundant given the site context, location or for other strategic reasons.

We can assist in the making of application to Council's for rezoning of land and/or for preparation of draft Local Environmental plans that may make specific uses permissible within the current zoning.

 Land & Environment Court appeals and preparation of expert evidence

We have many years of experience in the preparation of expert evidence for appeals in the Land & Environment Court whether this be by way of full appeal procedures or conferences pursuant to S.34 of the Land & Environment Court Act.

We have contacts with experienced solicitors and barristers who can provide the appropriate advocacy skills necessary in such matters.

 Planning due Diligence Reports and Development Potential

Plansight can provide reports in relation to the planning status of land, applicable constraints and the potential of the land for further development.

Such reports can be advantageous when considering the purchase or sale of property or when investigating the potential of existing land holdings.

 Pre Development Application Meetings (Pre DA meetings)

Depending on the nature and complexity of the matter we will recommend attendance at a Pre Development Application meeting with the relevant Council.

These meetings are valuable in the provision of relevant information that may assist in the preparation of the development application and save time after submission.

 Planning due Diligence Reports and Development Potential

We offer service to Local Government the assessment of development applications in situations related to Council owned land, in situations where they may be issues of conflict of interest and where workload determines engagement of external consultants.
